Samenvatting

THE CASE OF THE POPE delivers a devastating indictment of the way the Vatican has run a secret legal system that shields paedophile priests from criminal trial around the world.

Is the Pope morally or legally responsible for the negligence that has allowed so many terrible crimes to go unpunished? Should he and his seat of power, the Holy See, continue to enjoy an immunity that places them above the law?

Geoffrey Robertson QC, a distinguished human rights lawyer and judge, evinces a deep respect for the good works of Catholics and their church. But, he argues, unless Pope Benedict XVI can divest himself of the beguilements of statehood and devotion to obsolescent canon law, the Vatican will remain a serious enemy to the advance of human rights.

    Geoffrey Robertson mercylessly dissects

    - the Catholic Church's internal "punishment" system for dealing with sex offenders, whereby paedophile priests go largely unpunished, there's no recompensation for their victims, and (through transfer, notably to Africa and South America) offending priests are allowed to continue, the church's reputation being of prime concern
    - the Vatican's claim to statehood, based on a shady 1929 deal with Mussolini, when the church acquired "statehood" over the Vatican palace and its gardens, a 0,44 km2 plot of land within the city (and legal system) of Rome
    - the Vatican's heavy involvement and influence in today's politics as a result of this "statehood"
    - the pope's "head of state" immunity claim, granted by president George W. Bush, putting him outside jurisdiction (after already acquiring papal infallibility in 1870)
    - the current pope's misogynistic and obsolete world view
    - the current pope's involvement (as head of the Congregation for the Doctrine of the Faith from 1981 to 2005) in the hushing-up of sexual abuse cases

A most revealing and shocking book.
